Is it a Hippa violation when a Dr. is working in a joint office, opens his own practice and brings patient?
When an office has more than one practicing Dr, and one of the Doctors opens her own practice. The Dr leaving brings along records of patients she has attended to. Is this considered a Hipaa Violation? I have looked at many different sites, and can not find a definate Yes or No answer. Thanks in advance.
Also- Both Doctors from the prior office saw the patients. The records taken were of patients that prefer to see the Doctor starting the new practice.
i wouldnt say that it is a violation because the doctor is just transferring records back and forth, you didnt mention if the doctor is sharing the patients with anyone, so maybe she still wants to keep the patients she has and is just transferring the records to her new office. i dont see anythign wrong with that.
edit: then the doctor moving has every right to transfer records of those patients that like her better……there is no violation
