Can anyone tell me how the HIPAA law affects me as the custodial parent of children covered under an ex’s Ins

My ex is refusing to supply me with our children’s medical card. He has also gone one step further and informed his insurance company that they are not allowed to give me any information pertaining to our childrens health benefits. I am the custodial parent and therefore 99% of the time I am the one dealing with any health issues our children may have and any unpaid bills by the insurance. Insurance bills go to him however leftover Dr. bills come to me. As far as the cards go I have been advised by the child support unit (were the order is to supply medical) to file a violation but they are not sure about the insurance restriction. My lawyer advises me to write him a letter cc: his lawyer that if im not supplied with the cards that I will file a violation and ask for attorney fees. I am wondering about the restriction to calling the insurance company. I forgot to ask the lawyers office and hate to be a pain in the ass. Any help will be appreciated. Thanks!!

Have you contacted the insurance company? Surely they would release information if you can show them proof that you are the custodial parent as the law requires this. Most health plans have a grievance policy that allows you to file a grievance if you believe you have been wronged. Call them and ask them how to file a grievance. You can also file a complaint with the insurance commissioner in your state. Tell the insurance company that you plan to do so and they hopefully will bend over backwards for you as most companies do not want to be investigated. Be sure you are communicating with a supervisor or manager and not simply a customer service representative.
