HIPAA Violation or Just Personal Family Drama?
I had surgery last week to test for cancer. I found out late last week that my sister-in-law, who is a nurse but is not employed by my doctor’s group nor by the hospital I had my surgery at, was somehow able to log in and view my test results without either my knowledge or my permission. Then she relayed my results to my mother-in-law first, then to my husband. Not only did she invade my privacy without asking me first, but by the time my husband told me what had happened I was at least the FOURTH person in line to find out my own results!
I am LIVID. I don’t know what to do. I am in a terrible position because these are my in-laws and, like it or not, I will have to deal with them for the rest of my life.
Was this a HIPAA violation? Is there a way that I can obtain proof that she viewed my records? An electronic audit trail of some sort? If so, who do I contact to get that?
Thanks for any insight you can offer, but also for letting me vent.
WOW yes, that is a HIPAA violation. She had no right to even view the results, much lest blab about it to everyone else. How did this happen? If she isn’t employed by the hospital or doctor’s group, I don’t understand how she could “log in” to view it in the first place. And yes, there should be some sort of electronic time stamp to indicate who viewed what and when. You need to start by contacting your doctor and go from there. WOW I would be livid too. Good luck. Sounds like you need it dealing with illness as well as “family” like that!
