Who may be prosecuted for breaking HIPAA law ?
In California, hospital workers have been found to sell some medical info to the press about actors. Can they, along with the magazines who publish the medical info, be sued or prosecuted ? It seems if the hospital personnel can get into trouble, the magazines or newspapers that print it could also be in trouble as well.
The hospitals workers could be in trouble for breaking the law because they have taken the HIPAA training and signed acknowledgments of the laws. The magazines, while they fully know that ethically they shouldn’t and that HIPAA laws are in place they are not a HIPAA covered entity. They could be held civilly accountable, but likely not criminally prosecuted.
