I need opinions on if people feel this is a HIPAA issue?
I am a HIPAA compliance officer for a company who tries to get in home services for the elderly such as homemaker, personal care, home delivered meals, and respite care. To make a long story shorter I have been requested by our head office to provide a listing of names and addresses for people over the age of 100. I am worried about sending this to them in fear it would be a HIPAA privacy violation. I would like to hear opinions on people who are aware of HIPAA laws if this would be considered PHI that falls under HIPAA. People from the head office say it is not considered health information and does not fall under HIPAA. I understood it that since we have to comply with HIPAA, any information we send even if it is just a name has to be treated as health information. Any comments on this that can help clairify this. I have viewed several HIPAA sites but they all seem to not directly define if PHI is just “health” information when used with names, etc.
Keep the letter from your office requesting the information and their response to your question for your records.
We were told that we had to give the information to our administrative team becasue the agency owns the chart. However, if they release it , to an outside agency, that could create a problem.
If you would feel better, ask your clients if you can release the information because your agency is looking into finding other ways to provide them servies. Tell them that only their name and age will be released. No medical or mental health information. I found being honest with my clients to be helpful for the theraputic relationship.
