What are the HIPAA laws surrounding family counseling?
What if a girl who is 18 begins family counseling, does she have to sign the HIPAA laws? What happens if the counselor decides to share personal information with the girls parents, is that a violation of the law? This person did harm herself, however, the therapist then decided the parents needed to know personal details about why the girl was harming. The therapist now states that because she lives at home and her parents are paying for it, she can tell them the girls private stuff. This doesn’t seem right but I don’t know the laws. Any ideas?
The therapist also said that if she doesn’t commit to therapy once a week she’ll tell her parents things. This sounds like blackmail…
Yeah it actually has nothing to do with who is paying for the therapy. The person did harm him/herself…and the therapist has a duty to report it, by law. Since the person is living with their parents…the parents would be the contact people in this case. If the person was living on their own…it would be reported to the proper authorities.
