Deceased Hipaa

deceased hipaa

can a beneficiary claim benefits of life ins policy directly and skip agent?

i am beneficiary to a life ins policy from a deceased and the agent still has not filed the claim filled out a week ago because he says he needs a hipaa release from the executor of the estate. Can I just file directly with the life ins company and bypass the agent because i don’t trust him or his motives.

Yes, you can call the insurance company directly, and ask them to send you claim paperwork, and send that in.

But, the company STILL isn’t going to pay out, until they’ve had a chance to investigate the medical records of the deceased.

Them asking for medical records, usually indicates that the policy is less than two years old, or was less than two years old at the death of the insured, and that they suspect fraud. If there WAS a lie or ommission on the application, they won’t pay out at all. That’s what fraud does with life insurance – it voids the policy.
