Are 3rd parties responsible under HIPAA laws?
I recently applied with a US international airport police dept. for a civilian position. During background investigation, a personal reference I provided was asked by the police background investigator, to provide detailed information on an illness I suffered from. Does an employers questioning a prospective employees health status violate HIPAA or any other Federal Law in relation to employee rights?
Hippa only prevents someone in the medical profession from discussing it….nothing in HIPPA would prevent a friend from discussing it…if you really want privacy…dont tell anyone.
PS…the law doesnt prevent someone from asking…it only prevents people like me from telling….if it was illegal my department would have to arrest about 50 people a day that call in to find out where their relative was transported…they can ask..but we cant tell
