Do cleaning employees at hospitals have to follow HIPAA?
And if so, what can I do if a cleaning person breached my privacy rights?
I realized that the details I left out may affect the outcome of this.
Here goes:
A girl I had met before, because she is cousins with some friends of mine, apparently works at the facility I was recently a patient at. Upon seeing me she called and told her family that I was there being treated. I had chosen not to tell anyone, including my own family, and because of that, word got out to everyone.
I don’t know if that counts as being a part of my medical records… I’m not really sure if that violates my rights, other than I feel violated and it has caused weeks worth of explaining and stress.
Typically, yes, but more details would be appreciated. No matter what, if you feel your rights were violated, contact the hospital and an attorney. The worst they can all do is tell you to get lost.
EDIT: That’s sticky! If I were you, I’d report the girl to the facility even though I feel that it does not violate HIPAA. It would be a violation if she’d seen your name on a chart, certainly if she would have read the chart, but probably not if she legitimately saw you.
The real difference may be in what she actually said to your friend/family, that you were there, or that you were treated there? Huge difference. Like I said, I’d talk to the facility either way. Even if it’s technically legal, it’s crappy and frankly should be dealt with.
