Employers versus the Doctor?
I’ve been out of work for a week because I have the flu. I knew I had the flu so I’ve been taking care of myself without seeing a doctor. My employer calls me & requests a copy of a doctor’s excuse. I contacted my doctor to try to get a note but since I never came in for an appointment, they cannot provide me a note. I thought that my employer cannot retain my health information without my consent. I signed the HIPAA consent form at my doctor’s office & my employer was not listed to receive my health information. Does my employer have the right to my health information?
They have the right to request a doctors excuse. The excuse should not give the reason you were being seen, simply that you were.
