What evidence is needed to fine a person for a HIPAA violation?
I know someone terminated for a HIPAA breech Level 3 at the hospital they were working for. Now the accuser is pressing charges in federal court. Will the person have to serve time in jail?
Thousands of HIPAA violations have been reported to HIPAA authorities, without the funding to do a damn thing about it. This will not change until after some future election when enough politicians are elected who give a damn about privacy, which may not happen until more of them have their privacy violated.
Enforcing privacy in the mean time is in the hands of people who think this is important, and can do something about it in civil court. People do not go to jail when convicted by law suits. They just lose jobs and a lot of money.
