Is it a HIPAA violation to provide a copy of lab results without going over with patient first?
I had my lab results taken recently. But I cannot afford to go back to see my doctor to go over them with him this time. I’ve asked for a photocopy of the results (Blue Cross has already paid for them). He is refusing to give me a copy of my lab results unless I pay to see him and CLAIMS that it would be a HIPAA violation to do so. Is this correct? And if not, do I have any basis to file any kind of complaint against him for denying me personal access? (They also said they wouldn’t release it to another doctor if another doctor requested a copy of these particular tests.). Is is a HIPAA violation to deny and/or threaten access to these lab tests? Thanks.
It is a HIPAA violation to see the lab results. He can tell you over the phone. I asked my doctor to fax my HIV results to me (which were negative). He told me that it was a violation of the HIPAA act. That being that anyone could see these results, and there is no proof that noone could steal that piece of mail.
