FMLA or HIPAA Violation?

A friend was out on FMLA to take care of a sick family member. Her supervisor was speaking to coworker and stated he could not understand how she was out due to a specific illness. He did not believe that it should have been covered. He released specific Information on why she was out and believes he violated her privacy. Did he, and what did he violate?

A supervisor has no right to talk about one employee’s use or reason for use of FMLA with another employee unless the manager is talking with his supervisor or his peers to get advice on how to handle the situation.

If he had suspicions that your friend was abusing FML, then he should have either taken it up with her, or talked with his supervisor concerning his suspicions and what actions he can take.

If he talked about her with her peers, he acted way out of line.

His alleged violation would be covered under the privacy act, among other places.
She should take her concerns up with her second-line supervisor.
