Under HIPAA law,does my health ins carrier have to provide me with copies of any medical records they have?
I know my physician sent some medical records to my health insurance carrier and I would like to get a copy from the insurance carrier of what they were sent.
You can get them but you have to pay. Most ppl make the mistake to believe that the medical record belongs to them. That is so not true in so many ways. I thought the record would belong to the patient, but it belongs to the physician (only if it’s a private practice). If it’s not a private practice then it belongs to the facilty. In Okla. it is 1.00 for the first page and .50 cent thereafter. I don’t think they can refuse to sell them to you. You just have to prove that you are really “yourself!” And no I don’t think that they HAVE to provide you with anything. I don’t even think the insurance company can even release that information. You have to go directly to your doctor. Hope this helps
