Discuss any potential violations to the Privacy Rule ?
Katrina Katt, a 28-year-old woman, is seeing Dr. Orbit, a Gynecologist for treatment of a sexually transmitted disease (STD). Katrina is well known in the area since she is the morning anchor on a popular local television station.
Sabrina, a medical assistant working in the office, recognizes Katrina and is curious why she is seeing Dr. Orbit. Sabrina finds Dr. Orbit’s nurse and asks her why Katrina Katt was in the office. After talking to the nurse and looking at Katrina’s chart, Sabrina soon finds out that Katrina is being treated for syphilis.
A few minutes later, Sabrina emails her husband, Roger and tells him that Katrina Katt has syphilis. Surprised with the information, Roger then tells his coworkers and emails his parents to let them know.
Discuss any potential violations to the Privacy Rule under the Health Insurance Portability and Accountability Act (HIPAA). Could these violations be criminally punishable? Why or why not?
The first violation is with Sabrina who inquired about a patient she obviously didn’t have access to. Second violation is with the nurse, if Sabrina was to be privy to Katrina’s treatment she would have received a copy of her records- the nurse giving her unauthorized access is a violation. Sabrina then emailing her husband is the third violation. Sabrina’s husband wouldn’t be in any trouble because he is not obligated to the HIPAA rules. Sabrina, the nurse and the entire office could be held responsible for this information getting into public which could include civil and criminal penalties.
