Can an employer require a health assessment for all employees in order to be eligible for health insurance?
My employer has decided that to be eliglible for health insurance in 2008, all employees must submit to a health risk assessment. Employees not taking the assessment are not able to obtain health insurance through the group health plan.
Is is legal for companies to do this in the US? HIPAA does state that eligibility cannot be based on health, but I’m not sure I can refuse to complete the HRA and call it discrimination based on health or medical history.
I just don’t want my health information to be made available to my employer!
I don’t think they are looking to see if you CAN get coverage, but to see what rates the insurance company will charge. No one can be turned down for a group policy, but an unhealthy person can increase the rates. I’m guessing it’s a small company as large companies are not required to do this.
