Psychologist refuses to release test scores. According to HIPAA do I have the right to access that info?
I asked the psychologist to give me a copy of my test scores but he said that he could not release those scores (he only released a report explaining the meaning of the scores) because I don’t have the training necessary to interpret those numbers.
I was under the impression that according to the HIPAA the patient had the right to a copy of all the documents in his chart – as long as he pays, which I’m willing to do – as long as those documents are not part of the doctor’s personal notes. My understanding is that my test scores are not part of the doctor’s personal notes, so I don’t see why my ability to interpret or not interpret the scores is any of the psychologist’s business.
I care about whether or not I am entitled by LAW to a copy of my records.
If HIPAA does grant me those rights how do I see to it that they are enforced? Do I need to file a lawsuit or just hire a lawyer and have him give that psychologist a call?
