Is this a HIPAA Violation? Help!!?
I went to a well known drug store to pick up my medications. I was told that I already picked up one of my prescriptions 20 minutes ago. After some checking by the Pharmacy, they told me that they gave my prescription to someone else. On my prescription paper, it has my name, home number, address, birth date and insurance information. However, this also means that someone else now has my medication. Which, can be extremely harmful, especially to the elderly and children. Is this a violation of Hipaa?
I did contact the Attorney General. He said to contact my Insurance because of ID thief. My Insurance company, after safeguarding my information, told me to contact the Board of Pharmacy.
i dont think it falls under hippa violation. because someone didnt intentionally give your medical history to someone else….it was a mistake that could easily be fixed by the pharmacy. they ARE at fault though, usually pharmasists check to see if its the correct medication…
but then again i could be completely wrong….
