If a dr’s office transferred your chart to another dr, shouldn’t they have documentation to back it up?
I haven’t been to my dr in a few years, but I went the other day and they wouldn’t see me because they didn’t have my chart. They argued up and down with me that I had to have authorized them to transfer it or else they would still have it. I’ve never authorized a transfer and now they’re saying that they don’t know where my chart is. Isn’t there a law against that? I mean, I know a little about HIPAA, and to my understanding, even if you pick up your own records of anything health related, you still have to at least sign an agreement stating that you picked them up. And the dr’s office should keep that documentation on file. Am I wrong?
You are wrong – not about the transfer, but about the keeping. There is no requirement that a doctor keep records forever. Most only keep those on active patients and many define active as every year, cleaning out (or moving out) records of patients unseen for two years. Some keep longer and some can recover older records if given a few days to access the long term storage.
