Is it a HIPAA violation to post a picture of yourself and a patient to facebook?
I am not sure whether or not that patient is aware of the picture. But, regardless, I was wonder if it is in violation of any rules or regulations. Also, it is from a home health care aid and not taken in a hospital.
if it is a HIPAA violation, is there a reference number or code I can refer to?
If you read a HIPAA manual you will find it is a violation unless they have signed a release specific to the publication. Even oral permission could be costrued as not enough. If you are an employee, you could be immediately fired. My advice is to take the picture down.
