Is it legal for my employer to ask for proof of a minor child’s trip to the doctor?
My toddler son was extremely sick for the last 5 days and seems to have had the worst of it yesterday. Difficulty breathing, ear infection, no eating, throwing up, watery eyes, runny nose, cough, sneezing and lots of drooling. I called off of work (about 20 miles into my 35 mile trip) to tend to him. My wife and I then took him to the doctor. It was not possible for me to work any part of the day. Now my boss wants proof of his medical attention to validate my Paid Day Off. I get a certain amount of these days every year. They are to be used for vacation as well as sick days. What the hell? Is he violating HIPAA?
If he only wants to validate that you went to a doctor as you told him, then he isn’t violating HIPAA.
If he inquires about the diagnosis or asks any medical details, then he IS violating HIPAA.
You already volunteered the information about visiting the doctor and he wants to verify that you are telling the truth.
