Information on HIPAA Law?

I’ve been out sick since Thursday with a stomach virus. As much as I tried to talk my doctor into letting me go back to work Saturday, she wouldn’t. Her notes even say I can not return to work until Monday and that I need plenty of bed rest. Normally, I put my job before my health but I have felt horrible and decided to do as my doctor said. When I called my boss, she was furious with me and threatened to write me up, even with a doctor’s note, and she said Monday she wants my doctor’s phone number so she can call and speak to her herself. Now, I know this is illegal according to the HIPAA Law and I would LOVE to be able to find it, print it out and hand that to her on Monday. However, I can not find exactly what I’m looking for. Can anyone help me? I really need to point this out to her on Monday because next time, I’m turning her in and calling HR on her. I want to prove my rights.

You do not need to “prove” your rights–your supervisor had no rights speaking to you in the manner in which she did, (make sure you have documented this) and when you go back to work all you need to do is present your note from the doctor stating that you are able to return to work on this given day–usually , most companies require a doctor note to return to work after 3 days of sick time.You do not even need to inform your boss why your were out of work–HIPPA law states that and this is none of your bosses business. Your doctors phone number is on your “return to work ” slip–your boss can call her–but I will tell you that your doctor will not give her any information and might not even speak with her–You are protected by the HIPPA law. I would suggest that you do notify your doctor and her office of what your boss said to you–give them a “heads up” on this as-hol of a boss which you seem to have. You do not need to point anything out to your boss–she already knows what she did was wrong–and it is the Human Resource Department job to point this out to her–not you. You do not need any harassment from your boss when you return to work–if you do feel you are being harassed–document everything and once again take a formal complaint to your Human Resource Department.
Your job is not worth being fired over because you were sick for more then 3 days.

Do not say anything to your boss when you return to work–I would make a point to write a formal letter of complaint and discuss this with your Human Resources Department.
Also, I would suggest that every one with whom you speak to and when is also documented and that you keep this in a safe place.
