Do you believe it is necessary to have the HIPAA Security rule along with the HIPAA privacy rule? Would there ever be a case when there is a violation of the security and not the privacy rule?
Absolutely. The security rules cover how the data is stored both physical storage and electronic. If medical records were in a unlocked file cabinet in the doctors waiting room there may not be any actual cases of violation of the privacy rule if no one actually opened the cabinet and read a file. However it would of course violate the security rule as the data is not properly protected.
