Is taking a patient’s photo a violation of hipaa?

I took a photo of a baby in my RN OB clinical and my school is trying to kick me out of the program on the grounds that this is a HIPAA violation. I did nothing with the photo it is just on my cell phone

If you took the photo in the course of your duties, and it was for a valid medical reason, then it’s not a violation. For instance, if the baby had a rash, and you wanted to document the rash, and you put the photo into the baby’s records, that’s OK. But if the pic was a file on your own personal phone or camera, you should delete it before you leave work, leaving the info only in the baby’s record. However, if you took the picture without getting the parent’s permission, and you didn’t put the picture (or file) into the baby’s records, but kept the pic for your own purposes…that’s a violation of HIPAA.
