My health information was disclosed without my permission. Is this legal?
I am going through a custody battle with my ex. I had my child have a physical today. The Doctor is a witness (in my defense). Her lawyer wrote the doctor a note and provided some health information about me trying to encourage the Doctors testimony. Is this againt HIPAA? That was my personal information that was diclosed to a third party without my knowledge. When we go to court, is the judge going to allow this or can I get the lawyer in trouble?
HIPAA is a law that prevents only your doctor from releasing your information without your consent. Since the law applies only to doctors, it doesn’t place any limits on what your ex-wife’s lawyer can do or say.
