Is telling my family I am in the emergency room a HIPAA violation?
I went to visit my grandmother who is very ill in the hospital and inexplicably fainted. I was taken to the ER downstairs. I decided not to tell my parents or family because they are already under so much stress. I told the Patient Advocates and the Nurse specifically not to tell my family. When they arrived at 5pm for a meeting with the doctors to discuss my grandmothers’ health status, the nurse told my family what had happened. Is this a violation of the HIPAA privacy laws that govern RI?
HIPAA and other privacy laws are federal, so they apply in all the states.
However, if you are a minor, it is likely they do not provide nearly as significant a protection, and the hospital staff was probably obligated to contact your family.
If your condition was such that the staff reasonably believed that you would not be of sound enough mind to make medical decisions, then they are legally obligated to find someone with the power to make those decisions for you. Inexplicable fainting might trigger such a thing, depending on your other symptoms.
