Is it a HIPAA violation if identifying info is announced over an emergency radio?
Is it a HIPAA violation if identifying info is announced over an emergency radio? I can hear certain info being displayed over a family member’s radio when at home or in public while the family member is not on duty. For example, a dispatcher may announce that “a 76 year old asian male located at 1234 main street is complaining of difficulty breathing”. A responder ask over the radio, “what is the name”. The dispatcher may say over the radio, “John Rivera”. This individual’s name and address are considered identifiable information. Is this a HIPAA violation when certain uninvolved individuals can hear the information?
Maybe, maybe not. What is the written policy about having the radio on when you are off duty? That will determine if it is a violation or not.
