Employer wants medical information on aches and pains.?
The employer I work for is trying to get employees to fill out a discomfort level form. This is to be filled out by all employees who return to work from an occupational or non-occupational injury. It is also required of all employee once a quarter. Is the employer entitled to this information? Does this fall under HIPAA rules?
If a person was out due to an occupational injury/illness, then yes they can legally ask for that information. If you have been out of worked for more than a couple days requiring a doctors note, then yes they can request that info as well. If your employer is just asking everyone quarterly, then no….unless the job requirements are very physical and strenuous, then in that case they may have that right.
