Is my employer violating my HIPAA rights?
My employer is denying my return to work notes from my doctor stating that, “they are not administratively acceptable” because it does not “clearly state that I am/was incapacitated for duty” they have been telling me that the note must say how i was incapacitated ie., “cannot stand”, “cannot see” Is this ok?
First of all, you have no “rights” guaranteed to you under HIPAA. Entities have things they are required to do to protect your information and let you keep insurance, but that’s not the same thing as a right for you.
Second, your doctor has no right to give out your medical information without your consent. If you refuse to consent to have this information released to your employer, they have every right to fire you too. See how this works?
