For HIPAA in medical administration?
You are interviewing for a position as a biller for a psychiatrist who has just opened a new practice. During the interview the doctor asks you questions regarding your mental state. After the interview, the doctor informs you he will offer you the job providing you undergo a psychiatric exam and submit copies of your medical records. How would you feel about the doctor’s request? Is this acceptable under privacy rules?
He cannot ask you about your medical history or your personal life. A psychiatric evaluation is part of your medical history. He cannot give you a fair assessment because of a conflict of interest. I would decline this and see where it goes from there. He may be testing you. Just politely explain that it is against the law. I think this would NOT be a violation of HIPPA since you would be giving permission to disclose your medical records to him. He is abusing his power as a physician to expunge any and all medical records for purposes that are not medically related. He could even ask for your gynecological records! If you were interviewing with a banker, your medical information has nothing to do with your ability to perform your job. This may be a thinly veiled attempt at discrimination. If you don’t get the job, you can file a complaint with your local Department of Human Resources, and consider yourself lucky that you aren’t working for a lunatic.
In case you haven’t heard, psychiatrist are often “crazy” themselves.
