Hipaa For Employers

hipaa for employers

Is it a HIPAA violation for an employer to ask why you are calling in sick for work?

I really am sick, but I was questioned on what specific symptoms I was having.

They aren’t asking for your medical records, so HIPAA doesn’t apply. They do have a right to determine if you are in fact sick, but they aren’t entitled to specifics of your illness or treatment, unless you are asking for them to make “an accommodation” for some condition.

However it is pretty reasonable for them to inquire “what’s wrong” and you don’t have to get down to the nitty gritty. They can ask you to get a doctor’s note if there’s doubt.
