is it a HIPAA violation if my former employer sent my attorney my employee file full of patients names?
I was terminated after 10 years of service in a nursing home for minor documentation errors. (or at least that’s the reason they gave.) I am receiving Unemployment benefits after winning my first 2 appeals. Now my former employer is appealing again. They sent my lawyer my file WITHOUT the patient’s names blackened out. 73 names, first and last. Is this a HIPAA violation?
I know a HIPAA violation is unrelated to the unemployment case. My lawyer was shocked and said it was a HIPAA violation. The resident’s names have NO relevance whatsoever to the case or the hearing. They were sent by someone who is new and doesn’t yet understand policy. I am not trying to use it as leverage as suggested in a reply below. I don’t need leverage. I have facts and a very thorough paper trail, which my former employer doesn’t seem to be able to produce. I’m just very curious.
Yes, that is a HIPAA violation. The names of the residents should have been blackened out.
