question about HIPAA?
I work in retail and one of my coworkers thought it would be funny to disclose my medical condition to a customer. Can I get her fired under HIPAA or does that only apply in a healthcare setting? – Thanks
If it was one of the managing personnel at your work place disclosing your medical condition to a customer then you can sue your workplace and file a complaint with the Department of Health and Human Services Office for Civil Rights.
However, if it is just a coworker whom have came to know about your medical condition from you and not through any authorized review of your medical files with your employer then you can speak to the senior manager/s and see if you can get that coworker fired. You can also sue that individual for emotional distress & other things, by contacting a lawyer first.
