HIPAA violation question…?
If a doctors office admittedly violated HIPAA that had very adverse affects does that patient have the right to ask for monetary compensation in exchange for not reporting the incident to the authorities?
Yeah, you would be guilty of extortion at that point. There is no legal recourse for monetary compensation via HIPPA.
There are legal repercussions for the office involved and the violation needs to be reported.
If it is reported and proved then, if you can show actual damages, can file suit against the doctor’s office.
