Is it a violation of HIPAA to include names & dosages of medication siezed as evidence at crime scene?
I was just looking over an evidence list released by the police department involved in the case, and came across several mentions of prescriptions siezed from the suspect’s home – including name, dosage and prescribing physician.
As the state assumes responsibility for an inmate’s medical care, and the medications were identified by name & dosage to the public by agents of the state, hasn’t the state violated HIPAA by doing this?
HIPPA protects the contents of your medical records.
It does not protect information obtained outside of the medical network such as medications seized that were in plain view.
