Does HIPAA apply to this case?
I have had back pain over a month stemming from an auto accident in mid. september. The pain is sometimes more severe at times, and I have been to doctors multiple times in urgent care when it gets severe. I also see my regular doctor once a week. My boss asked me the other day, “what do the doctors to you?” and “do you get x-rays?” She has ripped my doctor’s notes, almost questioning their legitimacy. The union is very weak at my job and is basically in bed with management. It’s very uncomfortable going back to work after a sick day going to the doctor. This seems to be a direct violation of HIPAA.
Wow. What a terrible boss. Your boss can not deny you medical health care. If you want to go see a doctor and the doctor says you can’t work, thats it. No way around it. Your union seems lacking but it’s their job to uphold your health and performance on the job. Talk to them and see if they can help. If not, find a job where they actually respect you.
