I need to find a loophole in the Hipaa law so her power of attorney can not stop me from getting info.?
My mom is in a nursing home and has suffered some brain damage due to being in a coma. She is getting therapy but still unable to speak on her own behalf. Her husband is her power of attorney. He had some papers signed stating the nurses and Doctors could only release information to him. I have tried talking to the Dr.’s and nurses & they say I have to talk to him. The problem is I don’t want to talk to him due to his sexual advances and harrassment. Because I am unwilling to talk to him on a sexual level he will not talk to me at all concerning my mom.
I do not have the money to hire an attorney and am hoping there are some forms I can fill out or file with the courts by passing or making an exception to the laws keeping me from finding out even basic information.
It’s a federal law, and there is no “loophole” around violating the law or the privacy issues. You’d have to go to court to try and get information released to you; and you’d certainly need an atty.
With your mother in such bad condition, now might be the time to try and mend some fences.
