Will HIPAA protect deseased mental health patients?
HIPPA, the Health Insurance Portability and Accountabilty Act, protects the release of personal health information. In Nevada a mental health cemetery is filled with hundereds of patients buried in unmakred graves. A historical society asked the psychiatric institution the names of these people, but the institution wouldnt let up becasue of HIPAA. This case was taken to court. Who do think would win and why?

The graves are 50-100 years old.
Im not sure exactly why the soicety wants the names.
Probably going to depend on the age of the graves. I suspect that if the graves have some historical significance and all the historical society is asking for is the names, the judge may very well rule in their favor.
If the graves are more recent, then the families may have some privacy concerns and, in that case, the judge may with hold the information.
