Can a Dr. take home patient’s medical records?
recently noticed that a dr. had taken a lot of charts home with him overnight to chart them. I knew that per our practice that this was absolutely not allowed but I believed that it was a HIPAA violation too since the charts are not in a secured place. I reported the violation to my manager who took care of the problem.
The reason I reported him to my manager is because it was against company policy, in which I could have been fired had I not. When I informed my boss and asked her abt it she said that no he was absolutely not allowed to take home charts and that our office could be shut down for it.
The dr. found out I was the one who reported him and sayed something to me abt it. We were debating whether this was or wasn’t a HIPAA violation neither one of us knew for sure. So, is it or is it not a HIPAA violation and where can I read more abt this particular subject.

Removing charts from a facility is NOT a HIPAA violation. According to your question, it IS a company policy violation.
