Hipaa violation what do i do ?
I’m a cna and work at a nursing home. I had to report a treatment my doctor was giving me to treat scabies. At the time my doctor treated me a couple times using different medications to treat a rash. I reported to my supervising nurse that I was being treated by my doctor for scabies and wouldn’t be able to work. The same day she goes to the break area and announced in front of other Co workers that I have scabies. She put my name out there. Needless to say I have seen a dermatologist and it was a allergic reaction. Since her violating my privacy at work I have been treated differently. I’m lost and don’t know what to do. 2 cnas I work with told me she did this. I complained. To the director of nursing and administration but I don’t see them doing anything about it. What can I do and how serious is this?
You must be confused on what HIPAA is for.
You can read about it at the website below:
http://www.hhs.gov/ocr/privacy/hipaa/understanding/summary/index.html
HIPAA only applies to Health Plans, Health care providers (when dealing with patients that they treat – not employees) and Health Information Clearinghouses.
If your dermatologist told your coworkers – that would be a violation.
Nursing Home / Resident’s Dignity Rights / Reform Act
