How do I file a HIPAA violation against an attorney?
I have an attorney who sent my medical records and psychological evaluations to my former place of employment. He did not properly address the package and these records got to the department secretary, my supervisor, and some co-workers. These individuals have no legal right to my files or medical information. That information was to go to a specific department and remain confidential. Now my business and rumors are spreading throughout my former job. I heard of this from a friend who still works at that department. How do I file a complaint against this attorney? I live in California. I have a letter from a county investigator who investigated this that it was, in fact, my attorney who sent the files.
If it was a mistake, it is not a violation. To prove that your confidence was breached, you will need to show that it was a willfully malicious act
