Does my company’s policy break HIPAA Laws?
I work for a rebate processing company. We have a strict 90 day deadline from when a customer purchases an item that they must apply by. We rarely grant exceptions to this deadline, but when we do we only accept medical reasons. Part of this policy is to ask for confirmation of the customer’s medical condition from their physician. Is this legal under HIPAA laws?
If you’re not in the health industry nor process medical information as normal business operation, you’re not covered by HIPAA. The doctor however is covered and won’t give you info unless the patient expressly consents and specifies the kind of info needed and period covered. Better to instead have the patient get and submit the info to you.
