Hipaa Laws/patient signtaures?
If someone comes into a hospital, was able to sign for their belongings, was in hospital for at least one full day, but nobody made attempts to get HIPAA forms signed by patient, and after the full day the patient goes into a coma and never comes out, did the hospital break the law? The patient upon entering hospital was NOT in a life-threatening/immediate state of emergency. This is in the State of California. Any information would be greatly appreciated.
This is a minor technical violation. Yes, they technically violated HIPAA but there’s no material difference to anything. If the hospital made a habit of doing this they could expect a stern letter from CMS or a minor ding during their JCAHO survey, but that’s it.
