Can I sue if someone violates hipaa?
I’m in a personal injury lawsuit against this guys insurance company, the chiropractor sends them a copy of my medical records including past records not purtaining to the case without my permission. Do I have the right to sue the chiropractor under violating the terms of hipaa for giving them the records and not asking me first? I did sign a release form but it was for my lawyer but they sent them to the insurance company instead. please help.
If you signed a permission for them to release your medical records, they are not in violation.
You cannot pick and choose what you want released. Medical records include everything they have – otherwise it would be incomplete.
If you are suing, the insurance company has every right to them, according to the law.
