A 14 year old is pregnant, goes to hospital says not to tell parents, hospital tells or doesn’t?
does hipaa protect patient confidentiality or is the child considered a minor and the parents are told by the hospital?
This is purely a hypothetical question. I am a teacher of high school health science magnet with gt students some of which will be doctor’s. They ask good questions. I don’t care what u think! I am interested in the legal anwser. It;s either she is protected under Hipaa, or Ferpa takes control cause she is a minor, or the ER notifies the parents cause she is a minor, or she is considered an emancipated minor beacuse of the pregnancy???
I guess it depends on where you are, but I’d think that most hospitals would tell the parents because 14 is young and they are a minor.
It’s not patient confidentiality. Parents are responsible for the child until they are 18 years of age. The hospital could be held liable if the parents find out and sue.
