Today, what is considered the most important protection for consumers offered by HIPAA? ?
The most important protection offered is stated in the the very purpose of the act: HIPAA is and was intended to define your rights and protect your privacy as health records went electronic.
But sometimes the best laid plans of mice and men oft go astray. People in the health care field are largely confused by the act and rightly so. It is confusing as to what constitutes or does not constitute a HIPAA violation. As such, they over react and try to cover their backsides by making ALL privacy issues HIPAA related. In some instances, hospitals have refused to divulge the names of unconscious patients’ rooms to family members saying it would be a HIPAA violation. This is not a HIPAA violation but only ignorance and lack of HIPAA training on the part of some hospitals and staff members.
Aside from this, HIPAA and its enforcement have proved to be nothing more than a ‘spineless paper tiger.’ There have been thousands of well-documented valid complaints made to the Department of Health and Human Services that enforces HIPAA but to date, not one facility has been fined one red cent.
So we have an agency that has put in place a confusing, misunderstood act that no one enforces. It’s great to be paid for doing absolutely nothing. It’s a crazy world and this is only further proof of it.
