Do public schools have to obey the HIPAA Laws?

I kept my kids out of school yesterday because they had some extensive dental work done. The office lady told me that I needed to provide a doctors note excusing them from class. We’re 3 weeks away from the end of the year and my kids have only missed 2 MAYBE 3 days this whole year.

Is it legal for them to demand that I provide a note excusing them from class?

Most school policies are spelled out in the Student Handbook given out at the beginning of the year. Not sure where you live but where I am the public school policy is that ” after the 5th UNEXCUSED absence the child must present a Doctor’s Excuse (to be allowed to complete/make up any missed tests/work)” My child happened to have several bouts with minor sicknesses this year and I wasn’t about to run her to the Doctor for every cold she came home from school with. When her school tried to push the issue I went straight to the Board of Education and asked them what the policy/progress was to seek reimbursement for all the co-pays I would incur while satisfying their requirement of a Doctor’s excuse. I also told them I wanted to see the process they have in place to protect and ensure that my child is not contracting these minor illnesses while in their care ( do they wipe down EVERY surface EVERY day after school? or what? ) Needless to say, they shut up really quick about Dr.’s excuses and I am left to parent and care for my child (which really is my job anyway, I don’t need some Bachelor’s level newbie telling me what is best for my baby)

To answer your question: No they do not have any legal right to demand a Dr.’s excuse from you. They can try, put let them push the issue and then make them reimburse you for any legal fees you may incur while putting them right back in their place – which should be at the front of the class with chalk in hand. I know that teaching is a noble profession, but I absolutely hate the abuse of power. or the abuse of perceived power, in this case. Check your handbook – I feel safe in saying that if your children have only missed 3 days this entire school year then that lady nor the school have a leg to stand on and no right to demand anything from your family.
