If an agency published condolences on the death of a client in their newsletter, does this violate HIPAA regs?
First of all, only health care providers are covered by HIPAA.
Secondly, your death is not a secret or privileged information. Anyone, even a health care provider, can publish that.
Third, even if HIPAA DID apply in this situation, the family cannot sue because THEY were not damaged. The dead client was also not damaged, he was dead already, so the estate cannot sue.
