Does HIPAA law demand that paid collections be deleted from reports?
I had a dentist office that screwed up the billing with my insurance. So they sent it to collections. I ended up just paying out of pocket to make it go away. Transunion & Equifax deleted it but Experian won’t. They just marked it “paid/closed”. But since it’s medical related aren’t they legally supposed to remove it from my credit report???
Because of HIPAA, for privacy, medical debts can be treated differently than general consumer debts.
If a person has a medical debt that was sent to a collector, that person “has the right”, per HIPAA, to pay the medical provider, in full. If a person pays the medical provider in full, the medical provider must follow HIPAA and state laws concerning the account.
However if you paid the collector, then you waived your HIPAA rights and it can remain on your credit report.
