EMS HIPAA violation question?

I am the 2nd lt. for a rescue squad in upstate new york. We have a 16 year old girl who is currently enrolled in a NYS CFR class. How she got enrolled in this class is beyond me because she is not a member, and WAS an explorer, but the explorer post falls apart, but her status in the CFR class is not my question. She is now wanting to do ride time on our ambulance, and all the information i have found is that anyone who is a healthcare provider (ie. CFR, EMT) or a student enrolled in a class is able to do observations on an ambulance per HIPAA law. And unfortunately, instead of coming to us officers with her questions, she goes directly to our commissioners who have no say in a matter like this, but unfortunately cater to her needs. I was just wondering if she was allowed to do ride-time, and any other input anyone has on the situation
thats just it, its the liability issues, she is not technically a member, nor an explorer anymore, so i’m sure the insurance wouldnt like it

Look, you can’t be discriminatory about this, unless you want a big problem.

If your concern is liability, you go to the risk manager or risk coordinator, and ask them IN WRITING, if it presents a problem to have a minor on the abulance; and to clarify exactly who is responsible for the minor, and the actions of the minor, during their occupancy of the ambulance.

Your risk manager will run it past the corporate attorney and/or insurance company, get a written response, and give you a written response in reply. I would write that letter TODAY, and tell her that she cannot ride pending clearance of her minor status, and clarification of responsibility by the risk management staff.

If the commissioners overrule it, just have them do it in writing – which makes THEM responsible. Just say, “sure, not a problem, I’m just covering my a**, so I”m sure you’ll understand why I need you to put it in writing.”
